When Photo Matching is Required

The photo matching step is required when a new employee presents one of the following documents for the I-9 form:

  • Permanent Resident Card (I-551)
  • Employment Authorization Document (I-766)
  • Unexpired U.S. Passport or Passport Card

When a new hire presents one of these documents, you must make a clear copy and file it with the I-9 form. You must also send an image of the document to us at the time that the I-9 is sent for verification.

(Copies of any other documents including List B and C documents are not required unless your usual practice is to copy all documents. You do not need to send us copies of the driver’s license, Social Security card, etc. as long as the form is complete.)

We will conduct the verification as usual, but with the additional step of matching the photo on file to the image provided by the employee.

Failure to include the photo with your form submission will delay our response!

In the event of a photo mismatch, we will return to you a Tentative Non-Confirmation. If the employee elects to contest the non-confirmation, we will upload the image that the employee provided to DHS for additional verification. This process could take up to 15 days, during which time you can take no adverse action against the employee related to his/her verification status.
