Employers Should Continue Using Current Form I-9 After Expiration Date

The U.S. Citizenship and Immigration Services (USCIS) has informed employers to continue using the “Form I-9, Employment Eligibility Verification” released on July 17, 2017, despite the expiration date listed on the form of August 31, 2019, according to the “Edition Date” section of the Form I-9 web page on the USCIS website.

The “Edition Date” section currently reads as follows: “07/17/17. We will publish a new edition of this form soon. In the meantime, you may file using the 07/17/17 edition. You can find the edition date at the bottom of the page on the form and instructions.”

Since the USCIS has not announced when a new version will be published, employers should continue to use the current version even after the expiration date of August 31, 2019, until a revised version is available.

Once it is published, the new form will be available at www.uscis.gov/i-9 and here in the Client Help Desk.
